Fencing in Emerald
Emerald's first estate was sold in big blocks with no boundary fences, and its fences now answer mostly to Cardinia, with a strip of Yarra Ranges in the north.

A town that started without boundary fences
The Emerald Country Club was set up in 1923 on the northern part of the old Nobelius nursery, and the estate sold around it had no boundary fences at all. Its blocks ran from half an acre to several acres, around streets such as Elm Crescent, Poplar Crescent and Lakeside Drive, and the club vetted every house design.
Today, two neighbours who want a dividing fence share the cost of a sufficient one equally, and nothing gets built without a notice, an agreement or a court order. Dividing fences walks through the notice.

Mostly Cardinia, and its overlays
About 94% of Emerald is in Cardinia Shire and the rest, a strip along the north, is in Yarra Ranges. Check Cardinia's zone schedule for a front-fence height of its own; without one, the building regulations apply: within 3 m of the street, a fence over 1.5 m (or 1.2 m in brick or concrete) needs a building permit, or over 2 m on a declared road.
Most of Cardinia's hills overlays say nothing about fences. The Puffing Billy corridor's SLO1, the Menzies Creek valley's SLO4 in the west, the northern hills' ESO1, VPO2, VPO3 and the hills townships' DDO2 have no fence trigger, so the state's fence exemption is the starting point under them. Stokes Croft's SLO7 lets native vegetation go within 1.5 m of a side boundary or 2 m of a road boundary to build a fence; elsewhere, clearing for a fence can still need a permit.
Almost all of Emerald's house blocks are under a vegetation protection overlay and a design overlay. Some of those are VPO1, DDO1 or DDO4, which we haven't read for fences, so ask Cardinia's planners if your report lists one. On the Yarra Ranges strip, the farmland overlay SLO6 asks for a permit for any fence that isn't rural post and open-weave wire under 1.8 m.

Heritage places and the lakes
The planning maps show 14 heritage places in Emerald. On a property under the Heritage Overlay, a fence visible from a street or a public park needs a planning permit; a lane doesn't count. Cardinia's heritage schedule also names several Emerald places where fence controls apply, HO176 and the railway station's picket fencing among them.
Cardinia Reservoir lies entirely within Emerald, south of the township, and Emerald Lake Park and Nobelius Heritage Park sit beside each other in town. A council holding a public park isn't an owner under the Fences Act, and the Crown doesn't contribute for unalienated Crown land. A fence along either park is usually yours to pay for.

Fences in the bushfire overlay
The Bushfire Management Overlay covers 99% of Emerald. Beside a boundary fence built before 10 September 2009, a 4 m strip, both sides together, can be cleared without a planning permit. CFA's advice, not a rule, is to choose non-combustible fencing near the house. Clearing a fence line has the conditions.

Neighbours and their councils
- Cockatoo, Avonsleigh and Clematis
- Cardinia as well, so check the zone schedule for front fences; the hills overlays have no fence trigger.
- Macclesfield
- Yarra Ranges and SLO6 throughout, like Emerald's northern strip: the overlay doesn't require a planning permit for post and wire under 1.8 m.
